COLONEL'S CLUB TERMS & CONDITIONS

Effective as of February 1, 2021.

The Prestige Holdings Limited (“PHL”) Loyalty Program, known as Colonel's Club, was created to recognize and reward our loyal Kentucky Fried Chicken (“KFC”) guests. As part of Colonel's Club, members can earn points as explained below. Colonel's Club is a national program offered at all participating KFC restaurants in Trinidad & Tobago. Colonel's Club is accessible through the KFC App (the “App”). These Terms and Conditions (“Terms”) apply to your participation in Colonel's Club on the KFC App, and not to any other website, mobile app, product, service, or program offered by PHL.

In order to participate in the Colonel's Club, you must agree to these Terms.

Please read these Terms carefully, as they are a legal and binding agreement between you and PHL that apply to your enrollment and participation in the Colonel's Club programme. If you do not agree to these Terms, do not use this App or participate in the Colonel's Club programme.

Agreement and Legal Capacity

You represent that you have read and understood these Terms, and that you have the legal capacity to agree to be bound by these Terms and you hereby consent to these Terms, as well as the Privacy Policy that govern use of the Online Services. Nothing in these Terms require us to continue to provide the Online Services.

Use of the Online Services by any person under the age of 13 is prohibited

Minors who are at least 13 years old may only use the Online Services under the supervision of an adult responsible for them. It is that adult’s sole responsibility to monitor the minor’s use of the Online Services to determine what services and content are appropriate for the minor. Please note that there are parental control products or services available that may assist in this task, none of which is endorsed by or affiliated with us.

Eligibility

In order to join Colonel’s Club, you must be an individual and at least 13 years of age. Corporations, Partnerships, limited liability companies, trusts, or other legal entities are not permitted to enroll. Each Colonel’s Club member may have only one account linked to a unique phone number and electronic mail address (“email address”).

You are required to be actively subscribed to emails from KFC.tt and the Colonel’s Club to participate in the Colonel’s Club Loyalty Program. If you unsubscribe, you forfeit any loyalty points attained on your account.

Technical Requirements and Costs

You are solely responsible for any devices, operating systems, software, and services needed to use the Online Services. Prestige Holdings Limited does not guarantee that the Online Services will fully function on any particular device or with any particular operating system, software, or service. You are also solely responsible for any messaging and data charges, fees and taxes for your use of the Online Services, including when we communicate with you by text, email or other means. You acknowledge that certain uses of the Online Services (such as using them on a mobile device) may result in higher costs to you than other uses of the Online Services.

You may only use the Online Services with devices that you own or control and using only the authorized operating system (for example, iOS for Apple devices).

Registration and Enrollment

To enroll in Colonel’s Club and begin earning rewards, download the KFC App from Google Play or the Apple Store, and follow the steps below.

Joining through the Mobile App

Download the KFC Trinidad & Tobago App from either Google Play or the Apple Store by searching for “KFC Trinidad & Tobago on your smartphone or tablet device.

Create an account by submitting your first and last name, phone number, email address, and password.

Joining through the Website

Visit the KFC.tt website.

Create an account by submitting your first and last name, phone number, email address, and password.

When you enroll, regardless of method, you agree to the following;

(1) Provide accurate, current, and complete information about yourself, and

(2) Maintain and promptly update your information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activity that occurs under your account. You agree to notify PHL immediately of any unauthorized use of your account information, or any other breach of security.

If any information you provide SRG is not accurate or complete, we may disallow you from enrolling in the program, or we may cancel your membership in the Colonel’s Club Program.

Each person may only have one Loyalty Program account. If PHL finds that you have created multiple Colonel’s Club accounts, we may cancel all of your accounts. Further, PHL may refuse to allow you to re-enroll in the Colonel’s Club program.

PHL reserves the right to use your contact information to keep in touch with you in the ways you select when you enroll. If your contact information changes, or if you wish to change your contact information or the method by which we send you messages (e.g. start having messages sent to your mobile phone number), please log into the App or the KFC.tt website and update your contact information or preferences.

 Colonel’s Club

As a benefit of being a member of Colonel’s Club, you can earn and receive points that will count towards online purchases at any KFC Restaurant. Members will earn one (1) point for each $5.00 pre-tax spent on food and beverage (points are not earned for tax and gratuity), up to a maximum of 900 points per day. Colonel’s Club points are promotional and have no cash value. There are no membership fees associated with Colonel’s Club.

You may earn and receive Colonel’s Club as follows:

Qualifying Purchases:

Colonel’s Club members will earn and receive points by making qualified online purchases (food and beverage only) at participating KFC restaurants. After the payment transaction, your points will be applied to your Colonel’s Club account within a maximum of 24 hours of purchase.

Loyalty Rewards:

By accumulating 160 points per pre-tax dollar in your Colonel’s Club account, you will earn your first reward (a “Reward“), which you may redeem at participating KFC restaurants. Colonel’s Club may not be used for gratuity, tax, private dining events, gift card, or cash back.  Colonel’s Club loyalty points expire after 6 months with the exception of birthday points and other named promotional points that are awarded for use within a short term. Birthday Points expire within thirty (30) days. Promotional points when awarded will state the period of time in which guests must use. You may redeem up to a maximum of $500 in rewards per day at a participating KFC restaurant. Redemption of a Colonel’s Club Reward may not be combined with any other offer or coupon. If a purchase made with Colonel’s Club is less than the amount of the Reward, you may apply the remaining part of the Reward towards a future purchase.

Additional Rewards Program Terms:

PHL reserves the right to terminate your Colonel’s Club Account if we determine in our sole discretion that you have violated these Terms, you have more than one (1) account, or that the use of your account is unauthorized, deceptive, fraudulent or otherwise unlawful. PHL may, in its sole discretion, suspend, cancel, or combine Colonel’s Club accounts that appear to be duplicative, and may refuse to allow you to re-enroll in the Colonel’s Club Program.

PHL has the right at any time, with or without giving you prior notice, to:

End or cancel the Colonel’s Club points;

Change any Loyalty Reward or other Colonel’s Club or benefit we offer;

Change the requirements for earning points or a particular Loyalty Reward;

Change the time you have in which to earn or redeem a particular Reward; and/or

Change any other feature of Colonel’s Club.

If PHL ends the Colonel’s Club programme, points you have earned but not used will expire on the date Colonel’s Club is no longer offered. Earned but unredeemed Loyalty Rewards shall be void after such date.

Content & Use of the App

The KFC TT App and all content, information, and other materials featured, displayed, contained, and available on or through the App (collectively, the “Content“) is owned by or licensed to PHL and is protected by Trinidad and Tobago copyright, trademark, trade dress, patent, and/or other intellectual property laws. Subject to your compliance with these Terms, PHL grants you a personal, non-exclusive, non-transferable, limited right to access, use, display, and download this App for noncommercial purposes only. You may not otherwise copy, reproduce, distribute, transmit, display, perform, reproduce, publish, license, modify, create derivative works from, sell, or exploit, in whole or in part, this App or the Content.

You agree to use this App and the Content in accordance with these Terms and all applicable laws and regulations. PHL may prohibit access, use, conduct, communications, or content that PHL, in its sole discretion, deems to be harmful to this App, the Content, users, us, our brand, or any other person or entity, or that violates these Terms and/or applicable law.

Modifications

We may modify these Terms from time to time. When we do, we will notify you by email, through the App or in another similar manner. It is therefore very important that you update your account information or notify us when your email address changes. Any changes to these Terms will also be posted here. Your continued use of the App or participation in Colonel’s Club after any modification confirms your acceptance of the modifications.

Additionally, PHL may at any time, for any reason, and without notice or liability: (1) suspend or terminate operation of or access to this programme or any portion thereof; (2) change, revise, or modify this  programme or any portion thereof; (3) interrupt the operation of this  programme or any portion thereof for maintenance and support; (4) impose limits on certain features and services, or restrict access to the App; and/or (5) terminate the authorization, rights, and license granted herein. Upon termination, the rights and licenses granted to you herein shall terminate, and you must cease all use of the programme.

No Warranties

THE CONTENT OF COLONEL’S CLUB ARE PROVIDED ON AN “AS IS”, AND “AS AVAILABLE” BASIS, AND PHL HEREBY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, ACCURACY, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. WITHOUT LIMITING THE FOREGOING, PHL DOES NOT GUARANTEE THAT THE APP OR CONTENT WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

Limitations of Liability

IN NO EVENT SHALL PHL BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY DAMAGES (DIRECT OR INDIRECT) WHETHER IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE ARISING OUT OF OR IN CONNECTION WITH THIS  PROGRAMME (INCLUDING ITS MODIFICATION OR TERMINATION), THE CONTENT, THE COLONEL’S CLUB  OR THESE TERMS, WHETHER OR NOT PHL MAY HAVE BEEN ADVISED THAT ANY SUCH DAMAGES MIGHT OR COULD OCCUR AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY REMEDY.

Keeping in Touch with You

As a part of Colonel’s Club, PHL will send to you informational and promotional messages to the contact information that you provide as a part of your registration, such as messages informing you of improvements we make to the Program, new Rewards you may earn, new locations participating in the Colonel’s Club programme, new menu items you may want to try, and promotions happening at KFC restaurants. These communications may happen in the form of push notifications through the App and/or email.

Electronic Communications

When you visit the App or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email or by posting notices on the App. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. You further agree that any notices provided by us electronically are deemed to be given and received on the date we transmit any such electronic communication as described in these Terms.
